Air Resources Board (ARB) Will Be Conducting On-Site Inspections for Smog Compliance

Beginning in January 2010, all diesel vehicles that are 13,999 pounds GVW and lighter will be subject to the Smog Check program and will be inspected just like a gasoline powered vehicle. The testing of these diesel vehicles will also include testing of the on-board diagnostics for compliance and a visual inspection for evidence of tampering. To insure compliance with the new law, ARB will conduct unannounced on-site inspections of dealers' lots.

Before you display or offer your diesel vehicles for sale, you must get them smogged. The penalties for violations of this new law are quite high.

DMV AND LOCAL LAW ENFORCEMENT

AGGRESSIVELY GO AFTER CURBSTONERS

In January of 2008, IADAC sponsored AB 2042 by Assemblyman Fuentes to amend the law allowing DMV enforcement officers to cite and remove cars being illegally offered for sale. The results have been phenomenal!!!!!!!! To date, law enforcement has issued almost 200 citations, towed over 200 cars, and made 20 arrests. Additionally, they found several forged documents and stolen vehicles.

For all the years I have represented IADAC, curbstoning has been the Number One issue, with unlicensed dealers unfairly competing against you. With the new help from DMV and AB 2042, our long-time quest of putting these curbstoners out-of-business is finally becoming a reality.
