As a result of articles published by the LA Times alleging abusive practices by

Buy Here Pay Here dealers, your legislators have busied themselves drafting Bills

 that they think will remedy the alleged bad behavior of some dealers.  IADAC has

contacted the Ken Bensinger, the writer for the LA Times asking to give us the

names of the dealers who are responsible for the illegal acts.  He has provided

the names of two California dealers. 

 

AB 336 (Dickinson)  This bill suggested restrictions/regulations on vehicle title

loans made by pawn shops.  The original language of the Bill would have included

all auto dealers in this category, but IADAC lobbyist Bill Dohring successfully

 requested the language be amended to exclude auto dealers.  The Bill was shot

down in committee. 

 

AB 1447 (Feuers)  This Bill proposes the following:

  • Require auto dealers to display the sales price of a vehicle on the vehicle.
  • Prohibit dealers from requiring buyers to make scheduled payments to the

seller in person.

  • Following the sale of a vehicle, prohibits the seller from calling the buyer's

references, tracking the buyer's vehicle with GPS technology, or disabling the

vehicle with ignition override technology.

SB 956 (Lieu)  This Bill proposes the following:

  •  Impose regulations on dealers offering Buy Here, Pay Here installment

loans by requiring them to obtain a California Finance Lender's license, which

would provide consumers with an array of protections. (addn’l $25k bond, etc.)

  •  Limit used-car installment loans to a maximum 17.25 percent interest,

which would give California the strongest cap in the nation.

  • Change the way Buy Here Pay Here used car dealers are able to

repossess vehicles to include grace periods and make it easier for buyers to

reinstate a repossessed car.

 

AB1534 (Wieckowski)  This Bill proposes the following:

 

·         Every dealer, on or after January 1, 2013, shall affix a prominent label

on every used vehicle being offered for sale that states the reasonable

market value of that vehicle.

I am _____________ and my auto dealership is called_______________

in __________,California.  I oppose SB 956 for many reasons.  I have

been a dealer for _____years and help credit challenged buyers with

financing at my dealership.  SB 956 will hurt my business and my customers

because I cannot afford another $25,000 bond for the Finance Lender

license.  Also, the 17.25% interest rate is much less than they would be

charged at another dealer who finances through a sub-prime lender. 

That is unfair competition.  Also, if a repossession occurs the customer

should have to pay for all costs to reinstate the contract.  The dealer

should not have to lend him any more money than was originally agreed

upon.  I ask you to please vote “NO” on SB 956.
